| The 1972 Clean Water Act was amended in 1987 to include "Construction Activity" as an industrial activity regulated under Section 402 - National Pollutant Discharge Elimination System or NPDES permit program. Phase I went into effect in 1992. At that time the federal government, any state with delegated authority to administer this permit, and all municipalities with a population of 100,000 or greater had to write and implement regulations that adhered to the requirements in Section 402 of the Clean Water Act. This included administering a Construction Activity Permit program for any land disturbance of 5 acres or greater. |
